The General Terms and Conditions of the online store www.Lucifer-chocolate.si are drafted in accordance with the Consumer Protection Act (ZVPot), the Electronic Commerce Act (ZEPT), and the Personal Data Protection Act (ZVOP-1).

The General Terms and Conditions of Business address the operation of the online store, the rights of the user, and the business relationship between the provider and the buyer.

By placing an order for the purchase of selected items on our website, you agree to the general terms and conditions of cooperation and purchase.

Purchase Conditions on www.Lucifer-chocolate.si

The buyer confirms that they are familiar with the entire text of the General Terms and Conditions of the online store at www.Lucifer-chocolate.si (hereinafter: Conditions) and agrees with them.

The online sale on www.Lucifer-chocolate.si is conducted by the company LUCI, chocolate and chocolate products manufacturing, d.o.o., Šaleška cesta 19a, 3320 Velenje. The online store www.Lucifer-chocolate.si allows you to purchase Lucifer chocolate products online, as displayed on the subpages https://lucifer-chocolate.si/cokolade/. On the website www.Lucifer-chocolate.si, you can view our offer, information about the items, and prices. The purchase conditions are determined in accordance with the Consumer Protection Act.

Ordering

Online shopping at the online store www.Lucifer-chocolate.si can be done as a guest or as a registered user. In both cases, the details of the user’s completed purchase are recorded in our database. The registration process can be done through the purchase steps or separately on the “Login” subpage at www.Lucifer-chocolate.si/moj-racun. By registering, the user obtains their username, which is the same as the address of their email, and a password. The user’s username and password undeniably identify and associate them with the entered data. Registered users are thereafter allowed to view the history of their completed orders and the details of their user account. Users can change their account information at any time by logging into their profile. The protection of personal data is described below under a special point.

With each subsequent purchase, the user must log into the online store using the username and password obtained during registration. After logging into the online store, the user can modify, update, and view their data (address, access password, review past orders, etc.) in the User Page tab.

When browsing the offerings, for selected items, the user selects the option “Add to Cart.” The selected items are collected in the cart (icon at the top right), which the user can check at any time and edit the items in it (change the quantity and/or remove them from the list). The user continues the ordering process by clicking the “Proceed to Checkout” button, where they review the selected product list. In the cart, the user completes the entire purchase in 2 steps:

  1. Step 1: The user reviews their order (the list and quantity of items) and can make any desired changes; in case of a change in quantity, the amount in the cart is automatically recalculated. At this step, the user can enter a discount coupon that they previously received from the provider to benefit from an additional discount. The discount is calculated by clicking the “Confirm” button after the user has entered the coupon code. Promo codes may be limited by expiration, number, and value.

By clicking the “Continue with Order” button, the user proceeds to the second step of the purchase process.

  1. Step 2: Selecting the purchase method. Purchase without registration, login with an existing account at www.Lucifer-chocolate.si, or registration are possible.

In the case of a purchase without registration, the user makes the purchase as a guest, meaning that in the following steps, they only provide the data necessary for placing the order. This means that no user account has been created during the purchase that they could log into the online store in the future.

If the user has previously registered, they can in this step choose to log in with their existing account. If they have forgotten their password, they can reset it by clicking on “Forgot Password?” Otherwise, each new user can register by entering their email address and desired password (1x).

The user enters their email information, selects the delivery method (delivery via courier service (shipping costs will be displayed before order submission), enters personal details such as name and surname, delivery address (address, postal code, city, and country), and phone number. If the user wants an invoice in the name of a company, they must check this option and provide the company’s details: entering the company name, tax number, and whether they are a VAT payer.

The user chooses a payment method (by pro forma invoice, PayPal, or credit card), confirms that they agree with the general terms, and by clicking the “Buy Now” button completes the purchase and places the order. The user receives a purchase confirmation along with an email confirming the purchase, summarizing the purchase details sent to the email address they entered in the cart. In the case of payment by credit card, the user is appropriately redirected to the interface where the payment is finalized, and upon successful payment, a confirmation page of the purchase is displayed. Additionally, they receive an order summary at the entered email address.

Upon the user’s confirmation and execution of the order in the second step of the purchasing process, the company LUCI, chocolate and chocolate products manufacturing, d.o.o. sends an email confirmation of their order.

Before confirming the Lucifer chocolate order, the company reviews it and reserves the right to refuse in case the item is no longer in stock or in the case of clearly incorrect prices, which may arise due to automated transfer errors, about which the buyer will be informed as soon as possible. In case of uncertainties, verification of data, or ensuring delivery accuracy, the company may call the buyer at their provided phone number entered in the cart.

The purchase agreement between LUCI, chocolate and chocolate products manufacturing, d.o.o. and the buyer is concluded at the moment when the seller confirms the order. From that moment on, all prices and other terms are fixed and apply to both the company LUCI, chocolate and chocolate products manufacturing, d.o.o. and the buyer. The buyer is a person with the data provided at the time of placing the order. Subsequent changes to the buyer’s data are not possible. By placing the order, the buyer guarantees the accuracy of the data and simultaneously confirms the terms of business, recognizing and accepting them irrevocably and exclusively as an integral part of their order.

The confirmed order or concluded contract is stored electronically at the headquarters of the company LUCI, chocolate and chocolate products manufacturing, d.o.o., Šaleška cesta 19a, 3320 Velenje.

The costs associated with using electronic means of communication for ordering do not differ from the basic rate.

Material Defects, Complaints, Service, and Warranty

In accordance with ZVPot, the company LUCI, chocolate and chocolate products manufacturing, d.o.o. bears responsibility for material defects in the goods.

The buyer must notify the company LUCI, chocolate and chocolate products manufacturing, d.o.o. of any material defect, together with a precise description, within two days of discovering the defect and must also allow an inspection of the goods. LUCI, chocolate and chocolate products manufacturing, d.o.o. is not responsible for material defects in the goods found after the expiration of the legally prescribed period from receiving the goods.

The right to assert a material defect in the goods is regulated by the provisions of the Consumer Protection Act.

At LUCI, chocolate and chocolate products manufacturing, d.o.o., we are aware of the importance of complaints, so we strive to resolve them as quickly as possible to the mutual satisfaction and in accordance with legally binding provisions.

Complaints (returning incorrect, incomplete, or damaged goods) can be reported via email at choco@luci-chocolate.si or by phone at 03 588 30 80.

After confirming or agreeing with you, we will organize the pickup of the package via the Slovenian Postal Service or another provider. A copy of the original invoice must be submitted along with the goods.

The consumer must then return the goods to the company no later than 10 days after sending written notification of the consumer’s withdrawal from the purchase, with the consumer covering the direct costs of the return. The products must be unused and undamaged. A copy of the order must be included. The costs of returning the goods are borne by the buyer. The provider will refund the entire purchase price (purchase price with delivery costs) as soon as possible, but no later than 20 days after receiving notification about the consumer’s withdrawal from the purchase.

Prices

All prices are displayed in EUR and include VAT, which is clearly stated on the final invoice. Prices and other benefits (discounts, etc.) apply at the time of placing the order and have no predetermined validity. The listed prices apply only to purchases through the online store www.lucifer-chocolate.si and for the payment methods listed below under the specified conditions.

LUCI, chocolate and chocolate products manufacturing, d.o.o. reserves the right to change prices of the range daily without prior notice.

In case the price information is incorrect or if the price changes during the processing of the order, LUCI, chocolate and chocolate products manufacturing, d.o.o. allows the buyer to withdraw from the purchase.

Payment Methods

Regardless of the chosen payment method for the items, you will receive the invoice for the purchase of the items at your email address immediately after the delivery of the package or in physical form immediately upon receipt of the package.

The following payment methods are available in the online store www.Lucifer-chocolate.si:

  • by pro forma invoice** – after the purchase, you will receive payment details to your entered email address, based on which you carry out the payment,
  • by payment or credit card.

In the case of cancellation of the order or change of payment method by the user when paying by credit card online, please notify us at choco@luci-chocolate.si or at 03 588 30 80 for crediting the card or refunding the payment.

After receiving the payment based on the offer/pro forma invoice, the order is processed further.

When choosing the payment method “by pro forma invoice,” you will receive payment details in your email inbox: the payment amount, transaction account, reference, and purpose of the payment. In this case, you will pay for the ordered goods using a standard payment order UPN (form) at the bank, post office, or via your online bank. After completing the payment, you can send a payment confirmation to choco@luci-chocolate.si for faster processing of the order. The received pro forma invoice must be settled within 3 working days at the latest; otherwise, the company LUCI, chocolate and chocolate products manufacturing, d.o.o. will cancel the order.

Delivery and Pickup

The ordered goods that are in stock will be sent for delivery within a maximum of 3 working days after receiving the order or after receiving payment in the case of creating a pro forma invoice, unless otherwise indicated. Due to holidays or weekends, the shipping time may be extended, so we ask for your understanding. If the ordered goods are currently out of stock, we will notify you by email or phone.

Delivery is carried out in cooperation with the Slovenian Postal Service or another contractual delivery provider. If you are not home at the time of delivery, you can collect the ordered items according to the rules of the delivery service.

Before picking up the goods, the buyer is obliged to visually and numerically inspect the goods and note any visible damage to the packaging or goods. The complaint notification must be sent immediately to the email address choco@luci-chocolate.si or submitted personally at the company’s headquarters.

Delivery Costs, Invoice

The buyer pays the packaging and delivery costs. The cost is calculated based on the valid price list and the weight of the shipment. The shipping cost will be calculated and separately displayed before placing the order. VAT is included in the delivery price.

The packaging and delivery costs are charged at the time of purchase in the online store www.lucifer-chocolate.si.

The buyer receives the goods delivered to the address in accordance with the delivery service rules.

Upon receiving the delivered goods, the buyer will also receive the original invoice with all details and in accordance with the sales conditions published on this page and confirmed at the time of placing the order.

LUCI, chocolate and chocolate products manufacturing, d.o.o. will send the invoice to the buyer in electronic format to the buyer’s email address upon dispatch of the ordered items upon request.

In the case of personal pickup at the pickup point, the buyer will receive a printed invoice for the purchased items upon collection.

The invoice itemizes the price and all costs related to the purchase.

The buyer is obliged to check the correctness of the data before placing the order because any subsequent objections regarding the correctness of the invoices issued by LUCI, chocolate and chocolate products manufacturing, d.o.o. will not be considered.

Withdrawal from the Contract

The consumer has the right to withdraw from the contract without stating reasons within 14 days of receiving the goods and to send a written notice of withdrawal (the above applies exclusively to individuals acquiring the item for purposes outside their gainful activity).

In order to exercise the right of withdrawal, the consumer must inform the company LUCI, chocolate and chocolate products manufacturing, d.o.o., Šaleška cesta 19a, 3320 Velenje, email choco@luci-chocolate.si, phone: 03 588 30 80, of their decision to withdraw from this contract in an unequivocal statement (in writing by post, fax, or email).

In the case of withdrawal from the contract, the consumer bears the direct costs of returning the goods.

If the consumer has already received the goods and withdraws from the contract, they must return the goods to the company LUCI, chocolate and chocolate products manufacturing, d.o.o. as soon as possible or no later than 14 days after sending the withdrawal message (purchase). The goods must be returned undamaged, in unchanged quantities, and in their original, undamaged packaging, along with all accompanying documentation and a copy of the original invoice.

The company will refund the purchase price within 14 days of receiving the withdrawal notification. The company has the right to withhold the refund of the purchase price until the returned goods are received or until the consumer provides proof that they have returned the goods.

The right to a refund of the purchase price in case of claiming warranty and material defects is further regulated by the provisions of the Consumer Protection Act.

Complaints and Disputes

LUCI, chocolate and chocolate products manufacturing, d.o.o. respects the valid legislation on consumer protection and will do its best to provide an effective complaint handling system.

The complaint processing procedure is confidential.

LUCI, chocolate and chocolate products manufacturing, d.o.o. will confirm the receipt of the complaint within five working days and inform the buyer of how long it will take to process the complaint and keep them updated on the progress of the process.

Any disputes arising from the use of the online store www.lucifer-chocolate.si between the buyer and LUCI, chocolate and chocolate products manufacturing, d.o.o. will be primarily resolved amicably by the parties. If that is not possible, the competent court in Celje will have jurisdiction over the disputes.

LUCI, chocolate and chocolate products manufacturing, d.o.o. does not recognize any provider of out-of-court resolution of consumer disputes as competent for resolving consumer disputes that the consumer may initiate under the Out-of-Court Resolution of Consumer Disputes Act.

Protection of Personal Data

By concluding the purchase contract, you agree that we store your personal data and use them solely for the purposes of fulfilling your order (sending informational materials, offers, invoices, informing about novelties) and other necessary communication.

LUCI, chocolate and chocolate products manufacturing, d.o.o. undertakes to handle all acquired personal data in accordance with the Personal Data Protection Act (appropriate protection against loss, destruction, forgery, manipulation, and unauthorized access or disclosure by third parties). Despite the proper technical and organizational measures for data protection that we collect, LUCI, chocolate and chocolate products manufacturing, d.o.o. cannot exclude the possibility of data misuse, as the internet is an unpredictable medium despite security measures and security protocols.

The user is also responsible for protecting personal data by ensuring the security of their username and password and the appropriate original equipment on their computer, which is updated and has antivirus protection.

For the purposes of LUCI, chocolate and chocolate products manufacturing, d.o.o.’s business operations, the following user data is collected: first and last name, address and place of residence, email address, contact phone number, and any other data that users enter in forms on the website www.lucifer-chocolate.si. LUCI, chocolate and chocolate products manufacturing, d.o.o. is not responsible for the accuracy of the data entered by users.

About Cookies and Their Use

The amended Electronic Communications Act (Official Gazette No. 109/2012; hereinafter ZEKom-1), which came into force at the beginning of 2013, has introduced new rules regarding the use of cookies and similar technologies for storing information or accessing information stored on the user’s computer or mobile device.
